<p>The <a href="http://e3visa.info/2011/07/04/dv-2012-green-card-lottery-results-announcement-july-15-2011/" target="_blank">green card lottery winners</a> (diversity visa lottery) winners have been announced for Dv-2012 held online from October to November in 2011 twice in May and then again in July due to a computer glitch which we documented. Given a US Federal court upheld the decision to decide the winners again and deny the applications of those that were originally nominated as winners this year in May, that we will never see anything like that where false hopes are raised for so many around the world. Anyway you should note that being selected as a winner does not guarantee you a <a href="../2009/03/06/what-is-a-green-card-how-do-i-get-one/" target="_blank">green card</a> as you must pass some additional criteria as well in the application process.</p>
<p>Unfortunately those who missed out on the green card and permanent residency will NOT receive any notification but you will be able to check the status of their entry through the <a href="http://www.dvlottery.state.gov/" target="_blank">E-DV website</a>. You MUST keep the confirmation page information from when you entered the DV Lottery</p>
<p>Between April and July 2012 results should be sent out to the lucky applicants with an official letter from the U.S. Department of State Kentucky Consular Center in Williamsburg, Kentucky. All notifications are by mail to your nominated address and you should note that there is NOT any email notification. It seems like already people have started receiving their winning letters so hopefully this will be the case for all of you that read this post and applied!</p>
<p>The notification letters will have additional instructions, including information about additional forms and other documentation required as well as immigrant visa application fees.</p>
<p><strong>A couple of additional points to note.</strong></p>
<p>1. Be patient with receiving the 2nd letter if you have received the first as sometime the mail is slow. The only people that you can contact that will give you any insightful information if you are a winner and received the first letter is the KCC.</p>
<p>2. Check the US government websites to see the current dates for your number if you are a winner</p>
<p>3. If you were a child on a winner&#8217;s application and since turned 21 after being 20 at the time of application, you are still eligible as your age is frozen. However you must take up the green card within a year as otherwise you will be ineligible</p>
<p>4. High School education or its equivalent as per the requirements of the primary applicant means the successful completion of a twelve year course of elementary/primary and secondary education in the U.S. or successful completion in another county of a formal course of elementary/primary and secondary education that is comparable to the US 12 year education system.</p>
<p>5. If you are currently residing in the US on another <a href="../2009/04/07/the-difference-between-a-non-immigrant-and-immigrant-visa/" target="_blank">non-immigrant visa</a>, you are able to adjust your status within the US if you are a winner</p>

<p><strong>Now is the Green Lottery About to End&#8230;.</strong></p>

<p>In addition to this, a major stuff up by the US State Department in announcing the Green Card Lottery winners in May 2011, forced a recall 12 days later and a <a href="http://e3visa.info/2011/07/04/dv-2012-green-card-lottery-results-announcement-july-15-2011/" target="_blank">redraw and subsequent reannouncement of winners on July 15, 2011</a>. This gave a window for many of the anti-lottery proponents to pounce due to the increased media attention as the whole lottery is largely unknown to the American people.</p>
<p>Interestingly and unlikely ally has emerged in Foreign Immigrants (or more accurately what the US government calls non-immigrants) who are currently in the US on work visas or studying at US academic institutions particularly at the Graduate and phD level. Apart from the Green Card Lottery and direct Family sponsorship, the major avenue to a Green Card is sponsorship via an Employer under the <a href="http://e3visa.info/2009/04/14/how-to-apply-for-a-green-card-under-eb-3-eb-2-category-most-common-for-h-1b-and-e-3-visa-holders/" target="_blank">EB2 and EB3 visa categories</a>.</p>
<p>However due to long wait lists, non-sensical application criteria, costs and timelines and limited flexibility for an Immigrant, this option is frustrating and arduous as well. However many immigrants who have ensured years of long and difficult study and working in the same role for lesser pay and opportunities than their local counterparts with the constant danger (particularly in recent times) of job loss and having to return home immediately, watching others who just fill out an online form jumping the queue has been for some particularly hard to endure.</p>
<p>Some of the more rationale Green Card Lottery elimination proponents have proposed replacing the 55,000 Green Cards in the lottery to giving it to foreign graduates of US Academic Institutions in Engineering, Science, Technology and Media with Graduate or phD level degrees. Others argue this discounts the many foreigners who have show immense skills in the workplace and particularly in the start up world where so many new jobs and industries have been created benefiting the entire US economy.</p>
<p>Whatever the eventual result of this debate may be it is likely DV-2013 Green Card Lottery will still be held as normal in October and November 2011 with winners announced in May 2012. There currently is legislation before the US congress to end the Green Card Lottery. However it is our hope the US continues to be a vibrant economy and continues to realize the enormous value and potential of a constantly evolving society bring to all Americans.</p>

As we did last year we thought we do a general announcement post as well answer a couple of common questions we received over the past 12 months.</p>
<p>However soon following the results the State Department announced that due to a technology glitch, the winners would have to be redrawn as the announced winners were not random and purely just the first people who entered. This is obviously very unfortunate for those who thought they had won but of course completely unfair to those that entered properly but never really had a chance.</p>
<p>Ultimately the fair result is happening and every who entered last year still has a chance when the new winners are announced for the 55,000 lucky Green Cards on or around July 15, 2011.</p>
<p>You should note that being selected as a winner does not guarantee you a <a href="../2009/03/06/what-is-a-green-card-how-do-i-get-one/" target="_blank">green card</a> as you must pass some additional criteria as well in the application process. The actual DV-2012 visas will be issued between the period of October 1, 2010, and September 30, 2011. Applicants must obtain the diversity visa or adjust status by the end of the fiscal year.</p>
<p>Unfortunately those who missed out on the green card and permanent residency will NOT receive any notification but for the third year running, you will be able to check the status of their entry through the <a href="http://www.dvlottery.state.gov/" target="_blank">E-DV website</a>.<br />
You must have kept the confirmation page information from when you entered the DV Lottery between October and December 2010.</p>
<p>The results should be sent out to the lucky applicants with an official letter from the U.S. Department of State Kentucky Consular Center in Williamsburg, Kentucky. All notifications are by mail to your nominated address and you should note that there is NOT any email notification. It seems like already people have started receiving their winning letters so hopefully this will be the case for all of you that read this post and applied!</p>
<p>The notification letters will have additional instructions, including information about additional forms and other documentation required as well as immigrant visa application fees.</p>
<p>The Interviews for the DV-2010 visa lottery program begin in October 2009 and foreigners who applied overseas will receive an appointment letter from the Kentucky Consular Center about 5 weeks before the scheduled appointment.</p>
<p><strong>A couple of additional points to note.</strong></p>
<p>1. Be patient with receiving the 2nd letter if you have received the first as sometime the mail is slow. The only people that you can contact that will give you any insightful information if you are a winner and received the first letter is the KCC.</p>
<p>2. Check the US government websites to see the current dates for your number if you are a winner</p>
<p>3. If you were a child on a winner&#8217;s application and since turned 21 after being 20 at the time of application, you are still eligible as your age is frozen. However you must take up the green card within a year as otherwise you will be ineligible</p>
<p>4. High School education or its equivalent as per the requirements of the primary applicant means the successful completion of a twelve year course of elementary/primary and secondary education in the U.S. or successful completion in another county of a formal course of elementary/primary and secondary education that is comparable to the US 12 year education system.</p>
<p>5. If you are currently residing in the US on another <a href="http://e3visa.info/2009/04/07/the-difference-between-a-non-immigrant-and-immigrant-visa/" target="_blank">non-immigrant visa</a>, you are able to adjust your status within the US if you are a winner</p>
<p>Also FYI, the Green Card Lottery (DV-2012) will begin in October 2009 for those wanting to enter this year with more information about this lottery due by September.</p>

			<content:encoded><![CDATA[<p>The <a href="http://e3visa.info/2009/08/16/e3-visa-faqs-myths/" target="_blank">E3 Visa</a> as you know is an extensive topic covered on this site and along with the <a href="http://e3visa.info/2009/03/06/what-is-a-green-card-how-do-i-get-one/" target="_blank">Green Card</a>, <a href="http://e3visa.info/2009/09/12/green-card-lottery-2011-dv-2011-diversity-visa-opens-october-2-2009/" target="_blank">Green Card Lottery</a> and <a href="http://e3visa.info/2009/03/10/what-is-the-h-1b-visa-how-do-i-get-one-now/" target="_blank">H1B visa</a>, are the most commonly asked questions on this site from our readers.<br />
However lately we have noticed hat as the economy seems to be slowly waking up from its slumber in the US, many more Australians are asking questions as to how they can get to the US and <a href="http://e3visa.info/2009/01/19/which-are-the-best-places-to-find-a-job/" target="_blank">find a job</a> with an <a href="http://e3visa.info/2009/02/09/how-to-explain-the-e3-visa-to-a-potential-employer/" target="_blank">employer who will sponsor their E3 visa</a>.</p>
<p>As we have covered that top extensively from the above links, we won&#8217;t rewrite the same information here but will try and an address some of the more common questions we are seeing lately and relate it as much as possible to the current economic climate for foreigners in the US.</p>
<p>So one of the more positive signs is that many foreigners who come to the US on an <a href="http://e3visa.info/2009/05/10/f-1-visa-for-foreign-students-to-attend-us-college/" target="_blank">F1 Visa</a> for Students for undergraduate, masters and PhD level degrees as their stepping stone to <a href="http://e3visa.info/2009/04/20/how-to-get-your-e3-visa-indirectly-via-f1-visa/" target="_blank">finding employment in the US</a> have found their job prospects in recent months greatly improved. The greatest evidence of this comes from the <a href="http://e3visa.info/2009/02/25/h-1b-visa-quota-predictions-for-fy-2010/" target="_blank">H1B visa quota</a> numbers which in our recent <a href="http://e3visa.info/2009/12/14/us-immigration-update-december-2009/" target="_blank">US Immigration December update</a> which at the end of the US Immigration year on September 30, 2009 still had approximately 20,000 H1B visas unfilled. In recent years this quota has filled up in a matter of few days after the April 1 opening with even an <a href="http://e3visa.info/2009/02/07/the-h1b-visa-lottery-system/" target="_blank">H1B visa lottery</a>, so this shows how much has changed in the 2009 climate of fear.</p>
<p><a rel="nofollow" href="http://track.linkoffers.net/z.asp?ID=F0000000000001375470S9999" target="_blank"><img src="http://content.linkoffers.net/SharedImages/Products/282/639.gif" alt="" /></a></p>
<p>Well as of the latest update as we noted there is now only 2,500 left as the USCIS extended the time so the quota would be filled for FY2010. Most of these no doubt would have been taken up by students on F1 visas on their OPT who were already residing in the US. Job opening particularly in the skilled professional areas of Health, Education, Alternative Energy and Internet are high and even areas like Finance are picking up evermore.</p>
<p>However despite all this positive news, the challenge remains for Australians wanting to work in the US is that most of you are not in the US as a student or a <a href="http://e3visa.info/2009/03/14/j-1-visa-internship-int-professional-career-training-pct-programs/" target="_blank">J1 Visa Internship program</a>, that yes while their are more opening and the market prospects are not as bleak that still doesn&#8217;t overcome the geographical and other hurdles of convincing a US employer to hire and sponsor you.</p>
<p>We have had recent questions from people asking about whether they could look for jobs that are completely different to their qualifications and/or experience. In general, this is possible, but you do not want to deviate to far as when you go for your <a href="http://e3visa.info/2009/11/02/e3-visa-us-consulate-interview/" target="_blank">US Consulate Interview</a>, this may be a reason they could deny your visa if they deem their is little link between what you can offer and the job you will do.</p>
<p>Essentially the goal of hiring a foreigner as per the US Immigration language is to fill a role that they can&#8217;t find a suitable local to do. While this not necessarily what happens in practice, it is cited as a reason for denial when the candidate and job are seen as too far apart by the US Consulate.</p>
<p>People have also asked whether they could get 2 part time jobs on the E3 visa. This is certainly possible and an avenue that many people explore successfully. The additional requirement here is that each employer must file for ETA-9035(e) with the US Department of Labor to get an approved LCA. Then at your US Consulate interview you may have to answer questions as to how you will successfully navigate working for 2 companies simultaneously.</p>
<p>A couple of recent questions have also asked about the E3 Visa quota of 10,500 and whether it had been reached. Well there is no official tally anywhere and the only way to know for sure is to possibly try and ring the USCIS and see if they have a number. However in any particular year, we have not even got close that quota being fulled and not even sure if we have even got to the 60% full either. Additionally, <a href="http://e3visa.info/2009/03/02/extending-renewing-or-changing-employers-on-your-e3-visa/" target="_blank">extensions and renewals of the E3 Visa</a> don&#8217;t count towards the quota and nor do the <a href="http://e3visa.info/2009/02/04/the-partner-visa-for-us-working-visas-e3d-h4-j2-l2/" target="_blank">spouse or children dependent E3-D visas</a>. Finally the quota resets each year on October 1. So this US Immigration year known as FY2011 has only just started.</p>
<p>Back to the challenge of finding employers from so far away. We created the <a href="http://e3visa.info/2009/06/07/e3-visa-employer-database-list/" target="_blank">E3 Visa Employer Database</a> to try and help you for this as these are companies who are familiar with the E3 visa specifically and sponsoring foreigners as they have hired before so if contacting them or applying to open positions their it wont be as big a shock. However you may notice on many application forms that they ask whether you have work authorization as a question. The true answer to that question is NO as unless you have a working visa that allows you to work at a moments notice, then for that company to hire you they will have to do more than just hire you. Often it can pay to avoid those company as they usually reject outright if they are asking this question or if you are applying for a fairly standard (non highly specialized role) position, then it will be hard to stand out so much that they would hire a foreigner over an equally qualified US candidate given the simpler and quicker process.</p>
<p>Because of all this it can often pay to apply to smaller and medium size companies or contact people within companies directly and make use of recruiters which are a big part of US hiring culture at all levels. Use LinkedIn as a great resource to make contact with both recruiters and hiring people at companies you identify.</p>
<p>Finally as I have mentioned in other posts addressing this topic, be prepared to come to the US for interviews and pay some costs like travel to achieve your goal. It is rare you are going to be hired sight unseen and also that the first company that sees you will hire you, or that it will even be a one step interview process if you are going to be hired. I would say there would be a minimum of 3 contacts for a successful hire with one phone interview and 2 face to faces.</p>

			<content:encoded><![CDATA[<p>A lot has happened since our last General US Immigration update in November.</p>
<p>1. The <a href="http://e3visa.info/2009/10/25/green-card-lottery-update-dv-2011-lottery-october-2009/" target="_blank">Green Card Lottery DV-201</a>1 ended on November 30. During the initial week over 900,000 entries were received which was a 63% jump compared to last year and the Department of State expects 13 million entries to be the approximate total at the end.<br />
2. The <a href="http://e3visa.info/2009/06/01/green-card-lottery-2010-results-dv-2010/" target="_blank">Green Card Lottery DV-2010</a> have begun to enter the country and many are still receiving their 2nd letter and starting to go to their US Consulate Interviews<br />
3. The <a href="http://e3visa.info/2009/11/15/h1b-visa-november-update/" target="_blank">H-1B visa program for FY2010</a> that was extended into the new US Immigration year has picked up greatly with the latest <a href="http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=138b6138f898d010VgnVCM10000048f3d6a1RCRD" target="_blank">USCIS quota update</a> stating that 62,500 petitions have now been received in addition to the 20,000 advanced degree exemption. This means there is only 2,500 visas potentially left.<br />
4. US Immigration reform is still expected to be debated in the US Congress in 2010, however <a href="http://e3visa.info/2009/10/04/us-immigration-policy-and-healthcare/" target="_blank">health care reform</a> would have to finish up completely before it could start in any meaningful way.</p>
<p>December is usually a quieter month for Immigration news with so many holidays but given the swarm of additional questions and comments on the site in the last 3 weeks, I definitely encourage you to continue <a href="http://e3visa.info/2009/01/19/which-are-the-best-places-to-find-a-job/" target="_blank">searching for a job in the US</a> as there is definitely a lot more hiring now and it could be a good time to get set up leading into 2010.</p>

			<content:encoded><![CDATA[<p>The <a href="http://e3visa.info/2009/09/12/green-card-lottery-2011-dv-2011-diversity-visa-opens-october-2-2009/" target="_blank">DV-2011 Green Card Lottery</a> has now been open for 3 weeks approximately and millions of people from around the world have already applied at the <a href="http://dvlottery.state.gov" target="_blank">Official Green Card Lottery site</a>.</p>
<p>Many also have noted many issues with the site this year particular with checking and uploading their photo as per the specific <a href="http://e3visa.info/2009/02/22/the-diversity-visa-dv-or-green-card-lottery/" target="_blank">green card lottery requirements</a>. Please continue to try as it seems like a sporadic issue and many people have successfully applied.</p>
<p>Some of the questions we have been getting this year revolve around the;</p>
<p>- <strong>Spouse Condition</strong>: In the US for a foreign immigrant and for this application, a spouse is someone you are legally married too and must be man/woman relationship. The US does not recognize common law, defacto or gay marriage for foreigners so if you have someone like this they will need to apply for the lottery separately. If one of you win and you are in a heterosexual relationship, you will have to marry your spouse for them to be able to come to the US under your application.</p>
<p>- <strong>Documenting Children</strong>: All non US citizen children must be documented on the application as this can be grounds for disqualification. This is required even if you are not married or in a relationship with the other parent.</p>
<p>- <strong>Countries Allowed to Apply</strong>: We documented in your link at the top for the DV-2011 which countries&#8217; citizens are not allowed to apply. The only exception to this if you are a citizen of these countries is if at the time of your birth one of your parents was not a legal permanent resident or citizen of this country and was a citizen of an eligible country</p>
<p>- <strong>Social Security</strong>: For this question it means, have you ever applied for a <a href="http://e3visa.info/2009/03/12/h1b-e3-social-security-health-care/" target="_blank">US Social Security number</a> and not one in any other country</p>
<p>- <strong>Pending Permanent Residency &amp; US Visa Applications</strong>: Anyone currently on a US visa or applying for one, or going through a current <a href="http://e3visa.info/2009/03/06/what-is-a-green-card-how-do-i-get-one/" target="_blank">Permanent Residency Application</a> (Green Card Application) including t applications for the <a href="http://e3visa.info/2009/06/23/k-1-visa-application-process-for-fiancees-of-us-citizens/" target="_blank">K1 Visa</a> for Fiancees of US Citizens and the <a href="http://e3visa.info/2009/06/15/k-3-visa-for-marriage-explained/" target="_blank">K3 Marriage Visa</a> for spouses of US citizens can freely apply for the Green Card Lottery without any affect negatively to their status, visa or application.</p>
<p>The Green Card Lottery ends at the end of November so while getting your application early doesn&#8217;t mean you increase your chances, it is one thing less to worry about in case something happens to the site or you just forget because of the hectic nature of your own life.</p>
<p>Please also beware of the many scams operating at this time. You <strong>do not</strong> need to pay anything to apply for the Green Card Lottery as it is completely free via the US State Department official website.</p>

			<content:encoded><![CDATA[<p>This is just a quick post for everyone to remind them the <a href="http://e3visa.info/2009/09/12/green-card-lottery-2011-dv-2011-diversity-visa-opens-october-2-2009/" target="_blank">Green Card Lottery</a> DV-2011 (aka Diversity Visa Lottery) is now open.<br />
It is open for entry from October 2, 2009 through November 30, 2009 and there is only one entry per person allowed.</p>
<p>You don&#8217;t get extra credit for entering earlier in the process but it is good to be early of course!</p>
<p>Winners will get notified by mail in 2011 around about May to June although as with Dv-2010 you will be able to check whether you were successful or not online at the <a href="http://dvlottery.state.gov" target="_blank">US Government Official Green Card Lottery Site</a>.</p>
<p>A common question is what are the photo specifications as you can find this both at our main <a href="http://e3visa.info/2009/02/22/the-diversity-visa-dv-or-green-card-lottery/" target="_blank">Green Card Lottery Information</a> page as well as a online photo validater on the US Government Lottery site which will check the photo you upload.</p>
<p>This process is completely <strong>FREE</strong> and through the US Government so <strong>do not pay</strong> anyone else or go to another site to apply. These are all SCAMS!</p>

<p>Also to note as with last year&#8217;s Green Card Lottery DV-2010, the countries that are eligible an ineligible are the same.<br />
These include BRAZIL, CANADA, CHINA (mainland-born), COLOMBIA, DOMINICAN REPUBLIC, ECUADOR, EL SALVADOR, GUATEMALA, HAITI, INDIA, JAMAICA, MEXICO, PAKISTAN, PERU, PHILIPPINES, POLAND, SOUTH KOREA, UNITED KINGDOM (except Northern Ireland) and its dependent territories, and VIETNAM. Persons born in Hong Kong SAR, Macau SAR, and Taiwan are eligible.</p>
<p>There are exceptions if you are from these countries and say at least one of your parents at the you were born was a non resident or citizen of this country and is from an eligible nation, then you could qualify.</p>
<p>There are 50,000 Green Cards allotted and it somewhat apportioned for all parts of the world so that say not a big number will come from one country or even one continent.</p>
